Staten Island accident lawsuit settled for $285,000

On behalf of Michael J. Gaffney, Attorney at Law | Apr 6, 2016 | Car Accidents

If a New Yorker has been involved in a car accident and suffered injuries, they may be wondering whether to sue the other driver. Civil lawsuits that seek damages for car accident injuries are called personal injury lawsuits. Sometimes, accident victims will have to go to trial and plead their case in front of a jury. In many cases, however, a victim’s best option may be to find an experienced attorney to help negotiate a car accident settlement. Regardless of whether they go to trial, car accident victims can still recover damages to help them bounce back from such a traumatic event.

A New York man and his passenger were injured in a 2012 car accident recently settled his lawsuit against the owner and driver of the other vehicle. The accident occurred in Staten Island when the man was rear-ended by the other vehicle and suffered neck injuries. He was taken to the hospital after the collision and eventually underwent neck surgery, involving fusion and a bone graft. The man’s passenger also suffered neck and back injuries.

Previously, the judge granted summary judgment to the plaintiffs with regards to liability, finding the defendants 100 percent at fault. Before the jury selection process began, the case settled. According to the man’s lawyer, the man will receive the limits of the defendants’ insurance policy, which totals $250,000. The passenger will receive $35,000.

The damages received in a personal injury lawsuit can cover a variety of expenses from lost wages to medical bills. The less one has to worry about financial issues, the easier the physical and emotional recovery process will be.
